Terms of Service

By accessing or using the Volcanic website (volcanic.world) or engaging our professional services, you agree to be bound by these Terms of Service ("Terms").

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use our website or services.

Volcanic provides software engineering, artificial intelligence integration, cloud infrastructure, and related professional technology services to enterprise clients.

Specific deliverables, timelines, pricing, and scope are defined in individual Statements of Work ("SOW") or Master Service Agreements ("MSA") executed between Volcanic and the client.

We reserve the right to modify, suspend, or discontinue any aspect of our website or service offerings at any time with reasonable notice.

All content on this website — including text, graphics, logos, design assets, and code — is the exclusive property of Volcanic and is protected by applicable intellectual property laws.

Client deliverables and work product created under a SOW are governed by the intellectual property provisions of that specific agreement. By default, upon full payment, the client receives a perpetual licence to use the delivered software.

Volcanic retains the right to use general methodologies, tools, frameworks, and know-how developed during engagements for future client work.

Clients agree to provide accurate project requirements, timely feedback, and necessary access to systems and personnel required for project delivery.

Clients are responsible for ensuring that any data or materials provided to Volcanic do not infringe any third-party intellectual property rights or applicable laws.

Clients must not use Volcanic services for any unlawful purpose, including the development of systems designed to cause harm.

Payment terms are defined in individual SOWs. Unless otherwise agreed, invoices are due within 30 days of issuance.

Late payments may incur interest at 1.5% per month or the maximum rate permitted by law, whichever is lower.

We reserve the right to suspend services for accounts with overdue balances exceeding 45 days.

To the maximum extent permitted by applicable law, Volcanic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services.

Our total aggregate liability for any claim arising under these Terms shall not exceed the total fees paid by the client in the six (6) months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Both parties agree to maintain the confidentiality of all proprietary information disclosed during the engagement and not to disclose such information to any third party without prior written consent.

Confidentiality obligations survive the termination of any agreement for a period of three (3) years.

Either party may terminate an engagement with 30 days written notice. Volcanic reserves the right to terminate immediately for material breach, non-payment, or illegal use of services.

Upon termination, all amounts owed for work completed to date become immediately due. Volcanic will deliver all completed work product upon receipt of outstanding payment.

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana.

Parties agree to attempt good-faith resolution of disputes before initiating formal legal proceedings.

We may revise these Terms periodically. Material changes will be communicated via email or prominent notice on the website at least 14 days before taking effect.

Continued use of our services after the effective date constitutes acceptance of the revised Terms.
